1.How to Enter the Contest
94WYSP’s “Rock Madness” Contest will begin on or around 6am ET on 3/17/08 and will end no later than 11pm ET on 3/28/08.
To participate in this contest entrants must do one of the following:
(i) Go to the ‘Rock Madness’ page on 94wysp.com and complete an entry form, including your first and last name, complete address, city, state, zip code, date of birth, and valid email address, and ‘Rock Madness’ tournament bracket. Only one Internet entry per person and one Internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email entry. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the sweepstakes.
(ii) Print out and then mail in or drop off a complete entry form and ‘Rock Madness’ tournament bracket, Attn: Rock Madness, 400 Market St. 9th Floor, Philadelphia, PA 19106. Include your first name and last name, complete address, city, state, zip code, birthdate and home telephone number on the entry. Drop off entries may be submitted at WYSP studios, Monday through Friday during regular business hours beginning 10am ET on 3/17/08 through 3pm ET on 3/21/08. Mail entries must be postmarked no later than 3/21/08.
c.All email entries must be received by 5:59am ET on March 24, 2008. Email entries received after 5:59am ET on March 24, 2008 will be ineligible. All mail-in entries must be postmarked no later than March 21, 2008 and must be received by. Mail entries postmarked after March 21, 2008 will be ineligible. Drop off entries must be received by 5:30pm ET on March 21, 2008.
One entry per person per household.
WYSP is not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technological glitches. WYSP is not responsible for lost, stolen, mutilated, misdelivered, postage due, illegible or untimely entries. WYSP is also not responsible for any delays that may prevent a person from dropping off a timely entry.
2.Eligibility Restrictions
The contest is open to all persons who are 18 years of age or older and who legally reside in the greater Philadelphia metropolitan area. Employees of CBS Radio Inc., WYSP (the “Station”), its licensee, and each of their corporate parents, subsidiaries, and affiliates, their advertising agencies, participating sponsors/promotional partners, other radio stations in the Philadelphia metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. (CBS Radio and the Station shall be collectively referred to as the “Contest Entities”)
Only one winner per household is permitted in any Contest administered by the Station.
Contestants are required to provide truthful information and WYSP will reject and delete any entry that it discovers to be false or fraudulent. WYSP will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
WYSP reserves the right to disqualify, at its sole discretion, any contestant who is deemed to engage in unruly, illegal or disruptive behavior or whose behavior is otherwise deemed by WYSP to be inappropriate or offensive. Contestants must remain fully clothed during their entire appearance in the contest, meaning that women’s breasts and all genitals remain fully covered at all times.
3.Prizes:
One (1) Grand Prize: 42” LCD HD TV. Approximate Retail Value = $1500.
Grand prize winner will forfeit any prize or prize certificate not claimed within sixty (60) days of winning and an alternate winner will not be selected. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
Prize subject to availability and the Contest Entities reserve the right, at their sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable.
Winner must sign a Publicity and Liability release form within sixty (60) days of winning. Contest Entities reserve the right to remove or to deny entry to winner and/or guest if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event.
4.Selection of Winners
a.Decisions of Contest Entities management with respect to the Contest are final.
In order to determine the Grand Prize Winner, an on-air, head to head, single elimination song vs. song competition will be conducted weekdays, sometime between Monday, March 24, 2008 and Friday, March 28, 2008 (the “Voting Round”). In the six (6) round, sixty four (64) band bracket tournament, each song from its respective band will be paired off in competition against another. The Station in its sole and absolute discretion will determine song pairings. Listen to the Station during the Voting Round. Immediately after a pairing of songs from their corresponding bands are played back to back, the Station on-air personality will instruct listeners to vote via text message to WYSP1 (99771) to vote for their favorite song within the pairing.
If entering online you must log on to http://www.vibes.com/altentry/, fill out the information on this online form, including the text number which is the station short code (WYSP1 or 99771), and your entry will be automatically included with all entries submitted via mobile phones. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address.
One vote per person please. Contest participants are permitted to vote along with any other Station listeners. The deadline to vote is thirty (30) minutes after the on-air personality’s cue to text after each song pairing is played (each, a “Voting Period”). This elimination process will be followed for the remaining pairings and continue through the six rounds of the contest. The Station is not responsible for votes not received because of telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the voting process or who is otherwise in violation of the rules. The Station further reserves the right to cancel, terminate or modify the contest if not capable of being completed as planned, including tampering, unauthorized intervention or technical failures of any sort.
At the end of each Voting Period, whichever band has the most votes through text message will be declared the winning band of that round and will advance to the next round. If there is a tie at the end of the thirty minutes, the DJ will announce an extra five (5) minute overtime. There will be five (5) minute overtimes until there is one band with the most votes. ‘Rock Madness’ brackets will be scored as follows:
Advance through first round: 1 point
Advance through second round: 2 points
Advance through third round: 4 points
Advance through fourth round: 6 points
Advance through fifth round: 8 points
Championship round: 10 points
f.The one (1) entrant with the most points at the end of the tournament on Friday, March 28 will be declared the Grand Prize Winner, pending confirmation of eligibility. A random drawing will take place from all entries with the most points in the event of a tie.
Grand Prize Winner must execute and return any required affidavit of eligibility and/or liability/publicity release no later than sixty (60) days after winning prize or prize will be forfeited and an alternate winner will not be chosen. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize and an alternate winner will not be selected.
5.Conditions
Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to sign an IRS Form W-9 or the equivalent.
By participating in the sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this sweepstakes without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their guests, if any) to sign a liability release, agreeing to hold CBS Radio, the Station, its corporate licensee, and each of their parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
The Contest Entities reserve the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the sweepstakes and shall not be required to award a substitute prize.
f.Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Contest Entities.
The Contest Entities are not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
