94WYSP's "2009 Rock Madness" Contest
Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. How to Enter the Contest
a. The 94WYSP’s “Rock Madness” Contest will begin at approximately 6am Eastern Time (“ET”) on 3/16/09 and will end at approximately 11pm ET on 3/27/09.
b. To participate in this contest entrants must do one of the following:
(i) Enter Online:Go to the ‘Rock Madness’ page on the 94WYSP website (www.94wysp.com) and complete an entry form, including your first and last name, complete address, city, state, zip code, date of birth, valid email address, and ‘Rock Madness’ tournament bracket. To complete the bracket, you must predict which of two bands will advance based on listener votes during head-to-head competitions over a series of six (6) rounds. Thirty-band pairs of bands will compete in Round 1, sixteen pairs in Round 2, eight pairs in Round 3, and so on until only one pair is left in the final competition. Only one (1) Internet entry per person and one (1) Internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email entry. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the sweepstakes.
(ii) Enter By Mail or In Person: Print out from the station website and complete the ‘Rock Madness’ tournament bracket. Mail in or drop off the tournament bracket with the following information included: your first name and last name, complete address, city, state, zip code, birth date and home telephone number. Mail entries to Attn: Rock Madness, 400 Market St. 9th Floor, Philadelphia, PA 19106. Drop off entries may be submitted at WYSP studios, Monday through Friday during regular business hours beginning 10 am ET on 3/16/09 through 5:30pm ET on 3/20/09.
c. All Internet entries must be received by 5:59am ET on March 23, 2009. Internet entries received after 5:59am ET on March 23, 2009 will be ineligible. All mail-in entries must be postmarked no later than March 20, 2009 and must be received by 5:59 am on March 23, 2009. Mail entries postmarked after March 20, 2009 will be ineligible. Drop off entries must be received by 5:30pm ET on March 20, 2009.
d. One (1) entry per person per household regardless of method.
e. WYSP is not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technological glitches. WYSP is not responsible for lost, stolen, mutilated, misdelivered, postage due, illegible or untimely entries. WYSP is also not responsible for any delays that may prevent a person from dropping off a timely entry.
2. Eligibility Restrictions
a. The contest is open to all persons who are 18 years of age or older and reside in the greater Philadelphia metropolitan area. Employees of CBS Radio Inc., WYSP (the “Station”), its licensee, and each of their corporate parents, subsidiaries, and affiliates, their advertising agencies, participating sponsors/promotional partners, other radio stations in the Philadelphia metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. (CBS Radio and the Station shall be collectively referred to as the “Contest Entities”)
b. Only one (1) winner per household is permitted in any Contest administered by the Station. Contestants may win a prize in a contest conducted by WYSP only once every thirty (30) days and a prize valued at $600 or more only once every six (6) months.
c. Contestants are required to provide truthful information and WYSP will reject and delete any entry that it discovers to be false or fraudulent. WYSP will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. Prizes:
a. One (1) Grand Prize: 50” HDTV, with the make and model to be determined. Approximate Retail Value =$1500.
b. Grand prize winner will forfeit any prize or prize certificate not claimed within sixty (60) days of winning and an alternate winner will not be selected. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate. Winner must pick up prize at 94WYSP studios.
- There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
d. Prize subject to availability and the Contest Entities reserve the right, at their sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable.
- Winner must sign a Publicity and Liability release form within sixty (60) days of winning in order to claim prize.
4. Selection of Winners
a. Decisions of Contest Entities management with respect to the Contest are final.
b. The Grand Prize Winner will be the contestant who accumulates the highest score, as detailed below, at the conclusion of the Rock Madness Voting Round. The Voting Round will begin on Monday, March 23, 2009 at 10:00AM EST and end on Friday, March 27, 2009 at 6PM EST, and will consist of six (6) rounds of on-air, head-to-head, single elimination competitions involving sixty-four (64) bands. 94WYSP, in its sole discretion, will place the sixty-four (64) bands into thirty-two (32) pairings for Round 1. 94WYSP will then select and broadcast back-to back one (1) song performed by each band comprising each pairing. Immediately after the song pairings are played, the Station on-air personality will invite listeners to vote for their favorite song within the pairing via text message to WYSP1 (99771). Alternatively, listeners may log on to http://www.vibes.com/altentry/, fill out the information on the online form, including the text number which is the station short code (WYSP1 or 99771), and vote for their favorite song. Online votes will be counted the same as text votes.
c. One vote per person please. You need not be a contestant with a submitted bracket to vote. The deadline to vote is thirty (30) minutes after the on-air personality’s cue to text after each song pairing is played (each, a “Voting Period”). This voting process will be followed for all pairings and continue through the six rounds of the contest. The Station is not responsible for votes not received because of telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the voting process or who is otherwise in violation of the rules. The Station further reserves the right to cancel, terminate or modify the contest if not capable of being completed as planned, including tampering, unauthorized intervention or technical failures of any sort.
d. At the end of each Voting Period, whichever band has the most votes will be declared the winning band of that competition and will advance to the next round. If there is a tie at the end of the thirty minutes, the DJ will announce an extra five (5)-minute overtime. There will be five (5) minute overtimes until there is one band with the most votes. The band that advance to the next round will receive votes as follows:
Advance to second round: 1 point
Advance to third round: 3 points
Advance to fourth round: 5 points
Advance to fifth round: 10 points
Advance to sixth round: 20 points
Winning band: 50 points
Bonus: Picking both championship round teams: 25 points
e. Each contestant will received a score equal to the number of points received by all of the bands that the contestant accurately predicted to advance. The contestant with the highest such score at the end of the Voting Round on Friday, March 27 will be declared the Grand Prize Winner, pending confirmation of eligibility. In the event two or more contestants have an identical highest score, a random drawing will take place to determine the Grand Prize Winner from among all contestants with that highest score.
f. Grand Prize Winner must execute and return any required affidavit of eligibility and/or liability/publicity release no later than sixty (60) days after winning prize or prize will be forfeited and an alternate winner will not be chosen. If a potential winner cannot be reached, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize and an alternate winner will not be selected.
5. Conditions
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by WYSP in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this sweepstakes without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their guests, if any) to sign a liability release, agreeing to hold CBS Radio, the Station, its corporate licensee, and each of their parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Contest Entities reserve the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the sweepstakes and shall not be required to award a substitute prize.
f. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Contest Entities.
g. The Contest Entities are not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
h. Copies of the written Contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WYSP, 400 Market Street 9th Floor, Philadelphia, PA 19106.
